wills & estates

A Last Will and Testament is a written document that speaks for you after you die. I listen to my clients and express their wishes in the most cost-effective way possible.  I offer ease of mind to my clients (the “testators”) that their beneficiaries and executors will have guidance and certainty in terms of their responsibilities and the distribution of assets.

Do-It-Yourself Will Kits: Clients often ask me what is the difference between hiring a lawyer and the Do-It-Yourself Will Kits. Simply put, you get what you pay for.  The importance of good legal advice in having your wishes reflected in your Will should not be underestimated. A fill-in-the-blank Will Kit offers little to no explanation for the terms used or there may be critical omissions or errors made that may render your Will invalid or result in difficulties administering your estate after your death.

If you do not have a Will at the time of death, your estate will be distributed in accordance to the rules set by provincial law.

Powers of Attorney: There are two types of Powers of Attorney. Those that deal with decisions to be made for an incapable person with respect to property and those that deal with decisions to be made for an incapable person involving personal care.  Both involve different roles and duties however in both instances, a person must appoint his or her attorney for property or attorney for personal care before becoming incapable.

COVID-19:  In the Province of Ontario, there are strict rules that must be adhered to for a Will and Powers of Attorney to be valid and properly executed. The social distancing requirements and provincial shutdowns have created challenges for lawyers and testators alike in ensuring that Wills and Powers of Attorney are properly completed.  There is a way that this can be accomplished nonetheless.  I would be happy to provide guidance to you in terms of the steps that are needed once I have been retained.
